Question:

Is staggering hours legal in the state of CA? So thats they can fit 40 hrs in a 6 day work week? for no OT?

I WAS NOT HIRED IN FOR THIS. ALSO ISN'T THERE A WORK LIFE BALANCE THAT IT IS MANDATORY FOR A FULL-TIME EMPLOYEE TO HAVE 2 DAYS OFF?

  1. Then  quit.  No law prohibits what you are describing.  Every day is new contract and if you don't like what is being offered, you can negotiate or leave.


  2. Without a more detailed description of your hours, it's hard to tell exactly what you're talking about. Here are the basic hour laws for non-exempt positions in CA:

    1. You must get OT for all hours over 40 in a week. The week beginning and end can be at any time, but must be relatively stable. Changes to these days require notice.

    2. You must get OT for all hours over 8 in a day. The beginning and end of a day can occur at any time, but like the work week must be stable. This means that it is completely legal to require one to work 16 hours non-stop without OT, as long as the beginning of the next day is in the middle of the time.

    3. You must get 10 minutes paid break every 4 hours or major part thereof, and a lunch if you work 5 hours or more, and two lunches if you work 10 hours or more.
