Question:

Is the CSA legally obliged to this information?

I am the father of a child from a previous relationship. I live in the UK. The CSA has written to me asking for my partner's income details, national insurance number and wage slips. We've only been living together 3 months and aren't married. She's works for an employment agency so her work could stop at any time. Will they want to take money from her too? What will happen if she refuses to give this info to the CSA? Is she legally obliged to do so in any case?

  1. No you don't need to declare your partner's income

See the legislation here from The Child Support (Information, Evidence and Disclosure) Regulations 1992 http://www.opsi.gov.uk/si/si1992/Uksi_19...

which will give full details of your legal requirement to disclose

  2. Do NOT give them the details of your partner's income.  They are 'trying it on' because if you telephone them, the CSA, they will tell you that they do not have a right to that information. Do not worry so much.  I hope, for a start, that you are paying for the child and it is just that the CSA are trying to more out of you.  NEVER give cash to your ex only cheques or pay by bank transfers.

  3. Ok - as I understand it the CSA want to calculate all your income - you and your partner - so they can calculate how much they think YOU can afford for YOUR child's upkeep ..... I'm not sure they have a right to this information as in doing this they are then making your partner JOINTLY responsible for the upkeep of YOUR child.... I suggest two things .... TAKE LEGAL ADVICE ... normally a£5.00 or £10.00 initial interview fee with a solicitor (lasts about 45mins to an hour) will give you all the information you need - or if you can get hold of the Citizens Advice Bureau .... second tell them they need to write to your partner INDIVIDUALLY and ask for this information - it's HER INFORMATION not YOURS TO GIVE .....
