Is the circuit city franchise really going out of business? I heard it on the street and not sure if its true.

It looks more like they will be bought out.

Circuit City isn't but Comp USA is.

Nope, they won't go out of business anytime soon.  Blockbuster tried buying them out, but didn't offer enough.  No one else is yet to make a substantial offer.  They may turn into a private business, but won't go out of business.
