Is the curb (road) side of the sidewalk city property?

I live in Port Huron, Michigan, and have been having a little bit of an issue with some people from down the street. There's a tree that we always climb, and since I'm not really associated with them anymore, I want to climb it myself. Well, whenever I try, they yell at me to get out of their tree. (They're really immature for their age.) Now, the tree isn't in their yard, it's in that little section of grass inbetween the sidewalk and the road. Isn't that city property?

If it is like it is in Tennessee,the sidewalk itself is city property but is the responsibility of the people who own the property it is in front of.This means if someone falls on the walk,the people who live by the sidewalk can be sued.However,any area between the walk and the road is city property only.Also,there is a road right of way of so many feet(This varies) and it could be on this right of way,too


  2. That is city property - however....bylaws say that the tenants are responsible for the maintenance and care of the easement so it really is their tree.

  3. Probably on their property. The sidewalk is usually an easment for access for the city. If they claim the tree, find another one.
