Is the family responsible for a DEBT, after the family member dies?

My mother had died, and left in her name only credit card bills, is the family held responsible?

  1. Whomever inherits her estate is responsible.  The debt doesn't just go away.  That wouldn't be fair to whomever she owes money.  If you are next of kin, then it is probably your problem.  Consult a lawyer.  Laws might also differ by state.  This is why it is a good idea to take insurance out on elderly family members.


  2. It depends on whether or not there was an estate.  Estate means stuff.  For example, you can't inherit her jewelry or car if there are still debts to be paid.

  3. @Captain Awesome; "That wouldn't be fair to whomever she owes money." So it's fair to the family member who gets lumped with debts for someone he might not even have known that well, just because they're related?

  4. Her estate is responsible for the debt.  If there is no estate, then the debt will not be paid.  The debts do not pass to the rest of the family unless it is to a spouse.
