Is the guitarist from the Shins out of jail yet?

I heard he was out but i'm not sure. Does any body know why he was arrested in the first place?

On january 4, 2008 Martin Crandall was arrested after allegedly assaulting girlfriend Elyse Sewell in a hotel in Sacramento, California; he was charged with domestic assault. The case was dismissed on January 8, 2008 due to lack of evidence and no interest from Elyse Sewell to pursue further legal actions.
