Is the landlord responsible for replacing worn out carpet?

I have lived here 10 yrs. The carpet was already old when I moved in. Cleaning does not help the rug.

  1. Title 41 section 118.  Read it.  It gives you your renters rights for your state.  Each state is different.  Title 41 the sections 100-125 are helpful.

When you have lived in a location for that many years given that it is a reputable place, you can always ask to have some updates.  Doesn't mean it will be done, but you can ask.  If it is an apartment building complex, the complex has to do it.  If you are in a home apartment, sometimes a landlord will let you do the replacement on approval and take it off the rent.  Really depends on where you are at.  Just ask.

The landlord SHOULD be responsible for replacing the carpet, although I personally had a landlord many years ago who point blank refused!  In my case, I purchased a carpet for my living room and dining room, cleaned the existing carpeting and placed the new one right over it - I know it's not the best thing to do but esthetically it made a tremendous difference.  When I left, I rolled up the carpet and gave it to someone in the building who needed a new rug!!!

    Please check your legal rights, you can find all the answers to any landlord/tenant issues online and you can figure out how you can pursue this issue with your landlord.  If he or she is unresponsive to your request and is difficult to work with then follow the steps above!!

  4. Before I answer, talk to your landlord.  I did, we made a deal.  I bought the carpet and had it installed.  The landlord took the price off of my rent.

  6. Yes unless you stained and destroyed it. Since it was already old it shouldn't really matter if it was your fault.
