Is the owner of a house being sold as is required to make repairations suggested by the buyer?

I live in south carolina and am currently trying to help my mother sell the house she is living in now. The house was to be sold as is. We had a couple who made an offer and signed the Offer to Purchase agreement before they decided to come up with repairations they decided were necessary in order for them to complete the purchase of the house. Is the seller of the house required to make these repairations when the house was to be sold as is?

  1. No, sellers are not required to make repairs unless they agree to do so. Your mother is under no obligation to make repairs.


  2. You are not obligated to make repairs.

    Regarding lenders and repairs, a smart Realtor will know what is financable and what isn't going to fly, especially with FHA.   Take a look at what repairs are being asked for.  If it is cosmetic issues, pass.  If you have livability issues in this house, most lenders, especially a government backed program, is going to finance it.  

    You can offer it "as is" but unless a cash buyer comes with an offer, it is still going to need to pass basic health and safety inspections.

  3. This happens on every AS IS sale.  The buyers never understood what you meant.  They always thought you would fix "important things".  Either fix them or cancel.  Next time you write in the counter offer.  Buyer will not provide a list of repairs because seller will do no repairs.  THe buyers will still say they didn't understand what you meant.

  5. Evidently the buyers are not paying cash for the home and their loan company is requiring them to have these repairs done before they will OK the loan.

  6. Repairs are never a required part of any real estate contract unless the seller agrees to make them...however, the buyer can also decline to purchase.

    PS:  NO LOAN COMPANY REQUIRES REPAIRS during an offer to purchase!!!!!!

    Jeez!!!!  Appraisals aren't even done yet!!!

  7. No, it is not required.    A repair credit might be OK.   Otherwise you may end up making the repairs and have them back out.
