Is the petitioner in most divorces usually the man, or the woman?

That is, when a divorced couple decides to call it quits, one of them, either the man or the woman, goes to court and files, ie. as petitioner / plaintiff. Is that usually the woman or the man? I'd like to get this for California, but I'd settle for anywhere. Thanks

  1. I honestly think it is women who petition most often.  In my experience the one who petition usually has the upper hand in the case.  NC offers either partner may petition the courts, you can claim inreconcilible differences.

  2. Nationwide it is overwhelmingly the woman, like by 75%. I would expect it to be similar in California, but I'm not sure.

    they get bored and sick of the mans ****.......woman needs new exciting experiences every once in a while and if shes married to a man that is a couch potato and a lazy fuc%er....then shes sick of it.....therefor its a woman that initiates the devorce b/c ALL MEN ARE LIKE THAT!


  4. When the two couple can not getting alone any more and want to file divorced:

    In normal case, the custody will grand to the mom and dad will have visitation right. In the eye of the law want both party to work and come to there agreement. IF two party can not get to agreement than the court will step in and do what they think right ( for the best benefit of the children).

    before you even file divorced you should file custody as family court house. Will look better in court if you are the first one file the paper.

    have lawyer present is the best. To fight over the custody, you much have lot of work to do to prove she is an unfit mother. Other why she will have the custody and you will have your visitation right.

    If you and your ex are not stay in the same page than you will be in this court house very often ..........like 5 times a year
