Is there a definition of gross misconduct in english law?

if one were to fall asleep during an unpaid break, and it was disputed whether or not they had taken adequate or any measures to ensure their timely return,and they ended up being 25 minutes late,would that count as "gross"misconduct?can one legally be said to do anything deliberately whilst one is asleep?

  1. I would go to a doctor and get a doctor's excuse as there are several logical medical reasons for falling asleep during a break. You might have taken an allergy or sinus medicine and had a reaction to this medicine and fallen asleep. Or you might have a sleep condition which causes you to fall alseep and you cannot control this sleep. Please get a doctor's excuse and fight this discrimination. Good Luck!
