  1. There is usually a cap on any compensation for for the actual injury.  Workmans Comp (depending on the state) usually allows so many weeks for different body parts.  Ex:  Ankle could go all the way up to 195 weeks for a lifetime.  Generally, when the doctor releases you from your injury you will be rated a percentage of the disability.  About 4 months later you will go in front of an insurance commissioner for your particular state and he/she will award you some kind of compensation.  Usually, the commissioner will double the percentage.  So take 195=19.5x20%(40% if doubled)xweekly pay and that is usually what you will be awarded.  Once you accept the monetary award, you cannot make another monetary claim on the injury.  However, you still have two years to claim injury again.  Workmans Comp will usually reopen the case, you will be treated but you will no longer be able to receive any monies.  The above are just examples.  Hope this helps. If you are having issues and you are not sure, you may want to contact in injury attorney.
