If a married couple own one vehicle (purchased before the marriage) and it is in the name of the wife, if she were to die, leaving the auto to husband in the will, would the husband have to wait until the will was probated in order to re-register it ? Is it not easier to change title to joint ownership ?

  1. If a vehicle is placed in joint ownership, husband and wife, and one spouse dies, the vehicle does not have to go through probate, the surviving spouse can use the death certificate to put the ownership into the one name.  So, if a husband/wife is sole owner of a vehicle, he/she can gift half to the the spouse, and she can then be added as a legal owner.
