I've got a disgruntled 17 year old who got busted skipping and having s*x with a 19 year old. She was punished and banned from seeing him. So, she ran away and stayed gone for a while. Mad at me, she made some false allegations against me and got the authorities involved. After 7 weeks, she returned home and recanted her story remorsefully. Now the da's office has it and plans on prosecuting me for something I never did. Only thing I'm guilty of is being a firm parent. Sad part is, I'd be here either way, cause I'd reacted the same way. Please help.

  1. if your kid recanted, there's no case against you.  take her sorry *** down to talk with the da so they can hear it straight from the horse's mouth (as it were).  good luck and good for you for being firm.

  2. There's no guarantee that even if she does recant in front of the D.A. that they still won't prosecute thinking you said/did something to make her recant. If they do take you to court over it, you'll be given a lawyer if you can't afford one. I would say don't worry about it, because obviously they're going solely off your daughter's statement and they won't have that, so the case should be dropped.

  3. You have a right to an attorney. If you're indicted by a grand jury, you can request a public defender to represent you. Unfortunately, they're overworked and underpaid so you won't get the best attention paid to your case as you would from a firm that you were paying yourself. As for pro-bono, I'm not sure, you'd have to look in your area.
