Is there a ruling already on the books that state?

Children 16 years of age, that are recieveing public assistance whom is homeschooled, the parent(s) will be financially penalized $200.00 a month, until they put them back in public school?

I am looking for this information that applies to california.

  1. I'm not sure about California, but if you are the homeschool teacher...WOW!  You have at least 5 mistakes in your question.  Are you the teacher?  Recieveing/Receiving, whom is/who are, california/California.


  2. As far as receiving public assistance, you're talking about food stamps or welfare?

    As far as I'm aware, there are no financial restrictions for homeschooling; you can be a millionaire, or you can be below poverty level.  Just because you're receiving public assistance doesn't mean you need to be in public school.

    Now, if your family has not followed the laws for your state, you can be penalized - I would think that you would just need to file the paperwork, though.  They can't penalize you for homeschooling, but they can penalize you for truancy.

  3. No parent in California is penalized like this for homeschooling.

There may be laws saying that you can not get assistance for a child unless they are enrolled in school, however if the child is being homeschooled legally, then they are enrolled in school.  Make sure you meet the states requirements for homeschooling, and then tell them your child is enrolled in school.

    I am not an expert on the law, but I do know that many people assume things to be illegal that are not, social workers are not immune to this mistake.

    See Figure #1 in this discussion.  It lists the penalties available for application in cases of truancy in California.  (note:  This is dated 2004 and so changes may have occurred that would account for the figure of $200.00 that you cited.)  But, truancy only applies to homeschoolers if you are out of compliance with the homeschooling laws, and as others have stated, you can find that out through the HSLDA.

  6. We receive SSI for my son's "disabilities." We have also received food stamps while home schooling and have NEVER been penalized. The kids have to be enrolled in school, that doesn't mean public school. I don't know about Ca but since it is federal money I would assume that they can't penalize you.

  7. I do not believe that to be factual, however that is only because I have never heard of it and think it would constitute discrimination.  I can not cite whether or not it is actually a law.

    Check HSLDA-they would probably have information on their site if this were true.

  8. I am not familiar with CA law, but I do know that HSLDA has successfully addressed this issue many times.  Welfare cannot be withheld due to homeschooling neither can VA benefits or SS benefits.  I would go to hslda.org and read about cases on these issues.
