Question:

Is there a way to get this off of his credit report?

In my boyfriend's divorce agreement, his ex-wife was left responsible to pay off a credit card in his name. She's gone months at a time without paying anything on it, then made payments for a few months and so on. They've been divorced about two years, the balance was around $5000 and has been closed by the creditor. This is a huge negative mark on his credit--all of his other accounts are paid off and on time...can anything be done to remove this account that he's no longer responsible for, according to the divorce decree. We live in Texas. Any expert advice would be greatly appreciated.

  1. Anjell you seriously need to do some research before you answer these questions.

Spifiman is correct the creditor is not legally bound by the divorce decree.

  2. Well there's your answer right there...send a copy of the divorce decree to the credit bureau via registered mail. If it's a component of the agreement that he is not resonsible for the debt they have 30 days to reply and take it off his report. If not, report them immediately to the FTC.

    Ok Rockman..I'm not a lawyer..I'm just giving my opinion...geesh!

  3. Hate to tell you this but divorce decrees are only good for taking people back to court for violating them, creditors are not legally bound by them.

If you boyfriend was on the credit card account and obviously he was or they would not be reporting on his credit bureau he is equally responsible for paying no matter what the decree says and anyone who says otherwise simply doe's not know what they are talking about.

Since the information is correct, there is no way to remove it from his credit report, he needs to take his ex back to court and make her pay as she was ordered to.
