Is there a way to have child support garnished without my ex knowing I pursued it?

To the jackass who left a rude comment, I have a full time job!!! It's not like their dad's supporting them well enough so I can afford to stay at home with them!! Ignorant dumb ***!

  1. He should be paying the court ordered amount. You'll have to take the issue back to court to get the issue resolved. Of course he'll know you pursued it, who else would? I say do it for your kids and let him confront you and be a jerk all he wants.  


  2. No.  Because you have to go through the legal system, there would be no way of avoiding the issue with him.  I'm sure he will put two and two together even if you don't contact him directly.  If he gives you trouble, document everything and keep your lawyer and the court informed.

    have to file petition, have to request for court day, and have to served him paper.

    The judge will look at the petition and will make decision upon what he think it is fit.

First of all, your first responsibility is to your children.  He is a deadbeat dad.  Support is COURT ORDERED and he legally must pay that or he can be thrown in jail.  It is not for him to decide how much he feels like paying.  It is your responsibility to push the court system to garnish his wages to get the full amount that YOUR CHILDREN are entitled to.  Yes, it is also your responsibility to push to get the back support that he didn't feel like paying.  His feelings have nothing to do with this.  The lives and welfare of your children is what this is all about.  

    Be a role model for your children and show them that you are a strong person who will not let others walk over you or take advantage of you.   If he gets violent or confrontational, then slap a restraining order against him.  He is the one that is in the wrong here.  Stand up for your children.  There isn't anyone else who will.

    Do people not know how to read??  People she said that it is court ordered that he pays the $1050 per month but he only pays the $500 because he doesnt feel like paying anything more.  This mother is more than entitled to get the full amount of the court ordered support payments.  Whether she has a job or not has nothing to do with this at all.  The courts already evaluated all that and awarded HER CHILDREN the $1050 per month support.

  5. He will get a reply asking him to attend court. If he does not agree to the amount he has to modify it by law or he is responsible to what the court set up! If he does not show up ... after accepting the summons he will loose the arguement of the  updated amount!

  6. You do have several options available to you, but there's really no way that you can do it without him knowing that you are behind it.

    My question to you would be; why do you need anymore money? I mean, according to what you said, he gives you a total of  $1550 a month, that's alot of money! If he gives you the money every month, then you really shouldn't have any worries. If he doesn't well, then he would be in contempt of court, but even then you would have to get your attorney to do something about it.

    Honestly, I am kinda thinking that you should be happy with what you are getting, there are alot of us single parents out there that are lucky if we even get $100 every six months!!  

  7. If you go back to court about the child support and tell them that you have problems with him paying the full amount, they will more then likely garnish.  Unfortunately there is no way of getting so that he doesn't know about it.  Best of luck!!
