Is there a way to marry in the US without applying for a K-1 visa?

Then fill out the I-130 form?

I want to have everything in process while my fiance, soon to be husband, is still working in his country, instead of filling out tons of forms and making him stay in the US until everything is final. Whats our best option?

  1. Yes, if his visa has not yet expired, you can get married before it does expire. If hi is in a foreign country, and you decide to get married there you must file form 1-130  (PETITION FOR ALIEN RELATIVES). There is a filing fee of $355 for his form. Read instructions carefully. You mailed the above mentioned form.

    Then it may take months to receive a notice from USCIS in how to proceed next. (If everything is approved, HE should file I-485, G-325A, I-864, and I strongly suggest to apply for I-765 (EMPLOYMENT AUTHORIZATION) as soon as you file for I-485 -REGISTER AS A PERMANENT RESIDENT)


  2. It is allowed to marry and adjust status without leaving the US under certain circumstances. If your fiance has been working in the US for a while, and you've known each other for a while, and most importantly if he did NOT have any intention to marry when he entered the US (and the burden is on you to prove that he did not), then you are allowed to apply for adjustment of status.

    File I-130 and I-485.

    Also keep in mind that depending on the visa type he's currently in the US on, he may not be allowed to adjust status... but if he's working, chances are it will be fine.
