  1. There are many Defenses to the charge of Driving on Suspended Drivers License: http://www.osbar.org/public/legalinfo/12...

including an illegal stop or arrest, and a lack of actual knowledge of the suspension(a maximum sentence of five years in jail and a $100,000 fine)

However, most often the secret to a good result is getting the drivers license reinstated, and using it to resolve the case. When this happens, people can avoid the worst consequences of a suspended license arrest.

Persons with suspended drivers license should identify and correct the problems that lead to a suspension right away. And if you do not have a valid drivers license in your pocket , do not drive.

  2. I don't think that there is always jail time for that. It depends a lot on your attitude and the judges mood that day. Dress nice for court, call the judge 'your honor.' Be sincere! Don't try and bullsh** your way out of anything.

I had my license suspended for failure to pay a speeding ticket and I was scared every time I got behind the wheel of my car until I paid the ticket. I was afraid of going to jail. If you have fines to pay before court, pay them. Good luck!

  3. Maybe you can get really lucky like I did.

I got pulled over for running a red light while my license was suspended.  I told him my license was suspended and he let me go because he was about to get off and didn't want to do the paperwork!!!!!!!!!!!!!!!!!!(He told me)

In most places I know of you will go to jail and pay a ridiculous fine.

Good luck and don't get caught like I did!

  4. In most states, if you were stopped by the police for driving while suspended with a prior conviction of the same crime, you can be arrested.  You can also merely be issued a citation and a court date.  This is at the discretion of the officer.  In court you usually can pay to have your license reinstated and you are good to go.  If you are involved in an accident where someone is injured, a judge may decide to deliver a harsher penalty.

  5. Im Ga. No jail time. Nor courtdate. just a minor fine.
