Is there any agency that oversees the Auto Insurance Industry?

Had a truck that was in an acident, we had state farm and the other driver, had the same insurance co. It was decided that

  2. Yes and no, Each state has a Department of Insurance. There are rules and regulations that the Auto Carrier must follow when adjusting claims.



    I can only guess that State Farm held each of you a percent liable. Depeinding on what state you live in you may be barred from recovery if you are 50% at fault, others over and some you can recover the percent the other part is held liable, while others if you are 1% liable or at fault you can not collect anything.

      

    The Department of Insurance will check into your complaint and confirm claim practices were followed. Rare do they get involved in determing liability. State Farms liability decesion would have to be so far off the wall or just wrong for them to ask it to be changed. Insurance companies follow unfair claim regulations which are there to protect the public. While rare some times there are claim handling violations which would be logged against a carrier as a justified complaint. These regulations are more time frame driven and there are NO regulations that say a carrier must change a liability deceison.



    State Farm upon receipt of the report of the loss would start an investigation into the details and facts of what happen.  Once complete and they have all the information a liability deceison is made. The evidence should speak for itself. Adjusters can make a wrong call for many reasons. If you have not spoke with a Supervisor or Manager, I would suggest you do so. They will explain why they decided what they did and also explain the evidence that supports it.

  5. No all insurance is regulated by the states Dept of Insurance. Find yours states and file a claim with them if you feel that you were wronged and they will investigate the company's practices.
