Is there any laws that can help when buying a used car that you decide you dont want to keep after one week ?

i recently bought a used car at a buy here pay here lot and realized that i really cant afford the payments. i have only had the car a little over one week and i am wanting to give the car back and get my down payment back. i was wondering if anyone knows if this is going to be possible? the 30 day warranty isnt over yet and i am willing to let them keep a nice part of my down payment but want part of it back with me returning the car. Does anyone have any advice or legal knowledge as to how i can get this accomplished?

  1. You should know whether you can afford the car before you sign the contract. Once you've signed, you are locked in and legally obligated to make the payments. Your only hope is if the dealer gave you a return privilege IN WRITING. My guess is they did not. Car dealers aren't in the business of selling cars for a week then taking the car back and refunding your money. You are stuck with this car and if you don't make your payments on time, they will take the car from you, damage your credit, and you will still owe the amount your borrowed. Do what you have to do to make the payments as you promised you would.


  2. Wow.  No you dont have 30 days.  This is not a toaster purchased at WalMart - its a car.  Not 30, not 3, not 3 hours.  Once ink is on paper you have made a legally binding contract.

    If dealers had a 30 day return right, can you imagine how many cars would be "rented" for a free month?

    The dealer might be willing to work with you, but be advised he is not *required* to.  So go in and explain the situation.  See if they are willing to undo the deal.  They probably won't, but it cannot hurt to try

  3. if it has a 30 day warranty just bring it back and they have to (by law) give you your money back. if they dont then talk to the police about it but they should just give it back.

  4. the 30 day warranty is for breakdowns

    not the time you have to return the car.

    you signed an entered into a legal contract to buy this car.

    just because you can't afford it does not release you from paying for it.

    go talk to the seller and explain your situation but don't expect to get any money back.
