Is there any legal recourse for someone who took a minor to get a tattoo?

In California....is there any legal recourse if someone takes a 16yr old to get a tattoo? No small tat either it covers half of her back.

Adult age 25 took her minor cousin 16 yrs old to a convicts house to get a tat. she did this because she knew the shop had been getting raided for I think this sort of thing, so she specifically knew it was illegal and she is a felon on probation.

She specifically did NOT have the mothers permission. In fact her mother forbade the adult and child to do this.

What would the mother be able to do. if anything.....sue? the tattoo artist, the adult niece?

I think that it hinges on what role she had.  If she just drove her to get the tat, probably no cause of action.  If she gave consent, I can see a good cause of action.  You have a cause of action against the tattoo artist and parlor, as they gave a tattoo to a minor. Unless they were given a fake ID, they have no defense, they would have to 3rd party sue the cousin for fraud and misrepresentation.  You also sue the cousin as well under similar theories.  This is a winner

  3. small claims court. litigate for the $10,000 it will take to remove and extra $ for mental grievance. lawyer/law school student probably needed in CA to assist you.

    ... u cant sue the tattoo artist, the reason behind this is because first off she was with an adult, so the adult could have said that she was the 16 year olds guardian, if anything the lady should talk to her daughter about it first before going anywhere, now don't have her screaming at her daughter or she will never open up about it

    Now maybe you can go talk to a lawyer about this and get their perspective on this situation , if anything u wont have to sue but if u do anything you could always have the tattoo removed.  

    On the other hand getting the tattoo removed cost $$$$ and it will leave a mark, also if the girl has agreed to the tattoo theres not much harm she probably just wants to express herself... but if she was just doing it to be cool then  you have some problems....

    You might be able to sue the tato artist, but for all they know, the niece could have pretended to be the guardian... (which that could get her in trouble. Isn't that fraud of some sort? I dunno, something like that seems illegal)

    You could probably sue the adult niece, but what good would it do? Sueing doesn't change the fact that the tatoo was made.

    You could get the tatoo removed, payed for by the adult niece (since she took the 16 year old girl to get it...)

    You could also accept that your daughter got a tatoo... she got it & am sure she wasn't planning on hiding it from you forever. ...parents always find piercings/tatoos. Haha
