Is there any possible way to expunge DMV / driving infractions?

I received a DUI about 4 years ago in CA, and am now looking to change careers. A DUI in CA stays on your DMV record for 10 years. Is there anyway you can expunge charges on your DMV record like you can on your criminal record? Thanks for everyone's help!

  1. A DUI is not a driving "infraction."  It is a misdemeanor offense, and is on your criminal record, and will remain there for life, not just 10 years.

    If you have completed probation, the "expungement" provisions in California give discretion to the judge to issue such an order in a DUI case.  (Pen C sec. 1203.4.)  That will allow you to tell private employers that you were not convicted.  However, it does not remove it from the DMV record and your insurance company will still have access to it for the 10-year period, at least.

    This site will tell you how to go about it.  (The provisions making relief discretionary, rather than automatic, for DUIs, were just enacted this year, so the site may not have caught up on that.)

  2. Unfortunately, this sounds like a question that you need to ask your attorney.

    The California statute om DUI staying on your record for 10 years is quite specific.  If there is any way to get your record cleared prior to that, your attorney would be the one to ask.

  3. No, it stays for 10 years and after 10 years it will no longer show up on DMV record.  And it always shows up on your arrest record.
