Is there any way that i can my US employer to respond to 221(g) for an H1 Visa?

Hello,

My US Employer is not responding to the 221(g) queries raised by the US Consulate. Does anyone know of a process / lawyer / or any past experience that the employer can be persuaded legally to send me the information requested in the 221(g) Query.

Your answers would be highly appreciated.

  1. The employer cannot be forced, "persuaded" or anything else.  If they no longer want you or no longer want to deal with getting work permits for foreign workers, they don't have to.  If they do not want to provide additional documentation, there is nothing you can do.

    Over 380,000 Americans per week are being laid off.  And many employers are not renewing or are outright terminating work visas for foreign workers.  The economy is going very sour very fast.  The unemployment rate is rising faster than at any time in at least 30 years (some economists say 60 years).  So it is entirely possible that you need to look for a job in your own country.


  2. There's nothing you can do about it.  It's up to the employer to secure the visa for you.   Maybe the employer has had a change of heart and no longer wants to hire you.
