  1. Sure.  But not necessarily without being sued.


  2. Of coures you can , you have not made any payment so there for you do not really have a lease .

  3. Did you sign a contract? Whether or not you put down money is irrelevant. If the landlord wants to sue you for damages, you will probably lose - if you signed a contract.

    Personally, I would walk away from the deal if I was the landlord. I would think it was a gift from God to not have to deal with a flake. I would let you go and consider it a small cost compared to a possible much higher cost if you get in and flake out. But that's just me and my 25 years of landlord experience talking.
