Is there anyway i can get out of a ticket if the officer wrote it wrong?

i got pulled over by an officer for speeding, i believe the officer was actually off duty because his car was located at his house when i passed, about 4 miles down the road he came flying up behind me and pulled me over. i noticed on the ticket he wrote it happening on the 9th and 1030 am. the incident actually occured on the 8th at 1130 pm. i am just wondering if he was off duty and is trying to get by as putting he actually wrote the ticket the following day. he is known for pulling over people and breaking rules. he was actually terminated by the police dept of the next town over for violating rules. just a little help would be great thanks

  1. Yes, do listen to all these Yahoo lawyers here.  Some sure-fire ways to make yourself look like a fool.

    Mistakes can and do happen on citations all the time.  Normally, they are taken care of prior to court by sending the defendant an amended citation or some other type of document that changes the incorrect information to correct information.

    The officer can also bring it to the Court's attention on the day of trial and ask the judge to make the changes him/herself on the citation.

    The fact that you can prove you were elsewhere on the date and time of the citation you have in your hand does not change the allegation of speeding.  When it's addressed in court, the judge will almost certainly accept that mistakes can happen and the trial will continue.  You can certainly point out the mistake if nobody does it before you, but believe me when I tell you this is not the silver bullet you're being told it is.  

    It's important to remember you're not being charged with murder here...your exact whereabouts and clerical errors aren't nearly as important when you've been charged with a traffic infraction, judges are paid to wade through this stuff and see that justice is served.


  2. If a ticket is written wrong, like the date, location of offense, plate number, it's voided.

  3. If what you are saying is correct that is possible.  I think your best bet is to consult with an attorney and tell him this.  That would make an interesting court case.  I'm guessing this police officer didn't learn his lesson the first time around....

Its possible.  I would take the ticket to the courthouse and ask to have a hearing in front of a Judge or Magistrate.  It sounds like this officer is a loose cannon and the court is probably well aware of his cowboy tactics.  But.....you were speeding, don't forget that.  Slow down.  You will save gas and possibly someones life, like yours!

  6. Just get yourself a lawyer and go to the Police station and ask to speak to his SGT. Make sure you go to court and point out the facts. I'm sure you will be good and out of a ticket.

  7. it would be very easy to fight this ticket and win. the first thing you would want to bring to the judges attention is what you noticed about the date being incorrect. do this by telling the judge what you were doing on the ninth, and then say you actually received the ticket on the eighth. next, explain to the judge exactly what this officer was fired for, only do this if you are 100% certain of the facts of the case. good luck

  8. you would need some sort of proof of the date and time, like if you went to a shop that night the receipt or if you have something from the wrong date that makes it impossible for you to have been driving that rd at that time..
