Is there negligence if there r no cation signs posted on the job?

THE CAB AND THE PASSENGER COMPARTMENT WHICH WAS DESIGNED FOR THE CONVEIENCE OF THE DRIVER AS AN ENTRANCE AN EXIT I HAD TWO BRAIN SURGERY THERE WERE NO SIGNS OF WARNINGS OR CAUTION NOTED ANYWHERE AND SUPERVISOR PRESENT ALSO FAILED TO ALARM ME OR OTHERS OF LOW CLEARENCE IS JOB RESPONSIBLE FOR MY SAFETY

  1. maby signs should have been posted but you need to be responsible for your safety. there is always a way after an accident to have prevented it, the key is to be aware


  2. first and foremost,YOU are responsible for your own safety.you obviously are alert enough to list all of the things that were wrong,so why arent you looking out for yourself instead of looking for a way to blame someone else???Having brain surgery is no excuse,although you seem to think it is,if you are that incapable,stay home and call a medical service to transport you.

  3. No.   Anyone could have peeled the signs off,   you are responsible for watching out for your safety.

  4. What type of vehicle and was it intended for passengers?  Was it in an area where you should have been wearing a hard hat?

    I have whacked my head a few times above the door opening on a Ford pickup, but not hard enough to do brain damage.  Although, I did think they should have made that edge smoother.

    Note: Typing in all caps is impolite because it is hard to read and makes it look like you are SHOUTING!

  5. no open your eyes and quit trying to plug up our court systems with frivalous lawsuits. if you can't see that the clearance is low are you going to see a sign. the last person responsible for your safty is you!

  6. You are right, there should be fair warning of what might be unexpected or out of the ordinary. I don't know if there is negligence though for that is a legal term that is difficult to ascertain in every case.

    However I think we should not be complacent; we should at all times be responsible for our own safety and shouldn't rely on warning signs. If the clearance is low we should be able to take precautionary measures whether there is a sign or not.
