  3. Spyware is only illegal if it is installed without the PC owner's consent. It has many legal uses and can be purchased off the rack for you to install on your own PC. Many specialist stores will sell it.

    For example some Private Investigator stores sell Spyware to people who believe that their husband/wife is cheating on them. The Spyware can record their email and IM conversations. As the person is the PC owner it is all perfectly legal.

    A company can also install Spyware is they think that an employee is cheating them, or is using child pornography websites etc.

Spyware is illegal without the consent of the person being spied on, whether it's your own PC or not. And in that case, unless you're the IT admin of an organisation (and if you were, you wouldn't be asking this question), you might as well just watch them enter their credit card numbers so you can commit fraud later.
