Is this a legal self defense item?

I was looking into this product for self defense and I was wondering if this is legal in Texas. If you could site your source that'd be great.

  1. Maybe the Tex Dept of Public Safety could answer.  They do all the handgun permits and that seems to fall in a similar area.


  2. It is permissible to possess a "small chemical dispenser sold commercially for personal protection". 10 Texas Penal Code Section 46.01 (14).  This would include Pepper spray.

    For those in other states considering this question, while pepper spray is not classified as a conventional firearm, there are laws and local regulations governing it possession and use. A call to the city police department is a good place to start. Most municipalities of any size have community safety officers ready, willing, and able to teach local individuals and groups about the law and use of a wide range of non-lethal weapons.  Also, remember that state and local laws change. Even though in many states pepper spray can be purchased a number of places and carried by anyone at least 18, keep up to date on local changes in case you find yourself in the position of needing to defend yourself against an attacker and then in court.

  4. The link you gave says it only ships to the US with the exception of AK. This means it's legal everywhere else in the US.
