Is this against the law in this company I work for?

I have this boss who has my payroll schedule for every month on the 14th. On the 14th, I asked for my paycheck but he stated that he cannot give me a check because he has no funds or business is going slow. My mininum payment was suppose to be due on the 15th. I called the bank and they gave me $20 back which the total was $40. My boss said he can pay me on the 19th which is today, so far its 2:46pm and nothing yet. Is this against the law?

  1. Yes, and I am sure you signed paperwork to this point when you started.  Either way you have an agreement to do a certain amount of work (your time card) for a certain amount of pay (your pay stub).

    If you like this job and company, than approach your boss about possibly getting 1/2 pay on the 1st and 1/2 pay on the 15th.  Tell him you are committed to the success of the company, but you have bills to pay.

    If no help than you're state or city should have some kind of a labor board or labor commissioner.  Talk to them.

  3. Probably, but it would depend on local law and you didn't even tell us  what country you are in.

    In 'most' places it's illegal for him not to pay you on time. In many places there are fixed - and sometimes pretty severe - cash penalties for doing so.

  5. Yup - please initiate of new job search immediately...you aren't out that much money yet.  

  6. I would seek employment elswhere. Your employer is a poor business man. It is easier to find suitable employment while you are still employed, so I would start my search
