Estranged sister I haven't seen for 7 yrs. obtained restraining order against me through perjured affidavit, claiming I threatened her life and that she saw me following her. She lives over 2 hr drive away and I do not drive more than a few miles from home due to disability. I was unable to attend RO hearing because I could not get transportation.

Two weeks later, local police called on phone to ask if I was OK. They said my sister called and asked them to do a "wellness check" . I knew immediately that this was another form of harassment, as she thought they would come knocking at my door unannounced and counted on this frightening me. I live alone and am in fragile health. I told police to check their records for the RO and explained that my sister's call was an attempt to use law enforcement as means of harassment. They agreed.

Is this abuse of law enforcement a criminal offense?

  1. yes, probably.but if you look at the broad picture,ex wifes,ex husbands, people with a grudge, abuse this all the time. bottom line, its meaningless in situations like this.

  2. Probably not from only those 2 things.   Well, it is, but they would probably not go after her for it.

Take notes of everything that she does, and sign up for Pre-paid legal services.  This could expand into ugly, and you could use the legal advice and representation if it does.

Pre-paid legal costs about $25/month (and no I do not sell it), and can be a real life saver if your sister gets real stupid.

  3. I think you're both nuts!

  4. Get a temporary protection order against her.  This makes it an offense for her to contact you either directly, or through another person.

It will also send a message, that you will not tolerate any further harrassment.
