Is this an illegal eviction?

My friend lives in the same complex as me. She has never been late with her rent before. Rent was due on the 1st (and you have 5 days grace period), and today this is this second eviction notice she has received. They said they are going to start the eviction process and she will have to pay an extra $200 for that. How can they start an eviction process already? By the way we are in the state of Pennsylvania.

Is this legal?

  2. Well, if she has not paid her rent this month, it is entirely legal. In most states, a landlord can file an eviction against a tenant for any breach in their lease. This means if the lease says "Rent due on the 1st", the landlord can file suit on the 2nd. It would, of course, not be in his best interest...

    Anyway, yeah if the rent hasn't been paid an eviction action can be filed. Most landlords will say they will only drop the suit if you pay the attorney's fees and any filing fees involved (which is likely the $200).

    Your friend should probably speak to legal aid or a local attorney as soon as possible.
