Is this harassment? ..........some help please?

I have an outstanding balance with Money Mart.

I has a family, and dental emergency come up. So I was unable to pay them back.

I plan on paying them back as soon as I am caught up.

They won't stop calling me.

They have called my house 4 times a day (no joke) for the past two weeks.

They have called my cell phone 4 times everyday too.

Sometimes they call me at 10:00pm, when I am in bed.

They call my work 2 times a day, and today, when I got into work, there was an e-mail from them. They are now bugging me at work, between calling, and e-mailing, I am getting REALLY mad.

Is this against the law?

  1. In the US they can't call after 9 not 10.  They can call between 8 a.m. and 9 p.m.  Check with Canadian laws on collections.  I would think it would be the same.  Then write a letter and fax them and e-mail them a letter stating to only contact you in writing.  They have to abide by that.  If they don't you can sue them.


  2. it sounds like harassment.  in the US they cannot call after 10PM i don't know about canada.  talk to them and try to negotiate the loan. sometimes they will work with you.  don't talk to the person who answers the phone or calls they cannot help you, ask to talk to a supervisor. if they tell you they are a supervisor ask for their supervisor.

    or call back later.

  4. This will possibly expedite collection efforts but send then a certified letter asking them to cease and desist any communication with you.  

    Since this is the original creditor the same rules of collection do not apply to them so the letter may or may not stop te calls.  Have you tried to write a letter explaining your situation, give them a definitive date you CAN start paying and the amount you can pay?  Note I said write NOT CALL.  Never deal over the phone, only in writing!
