  1. Ok, first, stop watching/reading Fox News. Second, don't rely on sound bites to tell you the whole story. If you actually knew the context of James Fagan's words, you would understand that he DOESN'T want rape victims to be put on the stand and ripped apart by defense attorneys.

    Democratic Representative James Fagan was in the Massachusetts State House yesterday railing against Jessica's Law, which would mandate 20-year sentence for rape of a child under 12. As a defense attorney he took offense to the idea that someone convicted or raping a young child should have a mandatory sentence imposed on them, arguing it would force him to attack the little girl in order to defend his client:

    “Let me tell you why it's so wrong, It's so wrong because in these situations . . . that 6-year-old is going to sit in front of me, or somebody far worse than me and I'm going to rip them apart. I'm going to make sure that the rest of their life is ruined. That when they're 8 years old they throw up; when they're 12 years old, they won't sleep. When they're 19 years old they'll have nightmares and they'll never have a relationship with anybody. And that's not because I'm a nice guy. That's because when you're in court, and you're defending somebody's liberty, and you're facing a mandatory sentence of those draconian proportions, you have to do every single thing you can do on behalf of your client. That is your obligation as a trial lawyer."


  2. No, that is how defense attorneys show concern for their clients. If they are hired to defend a person against the word of a child who has allegedly been sexually abused, an attorney has to try and prove their client's innocence. Sad, yes, but it is also very true.

    Hey I don't like anymore then everyone else here.  Fagan also points out why I couldn't be a trail lawyer, because I would have to defend to the best of my ability, scumbags that I knew were guilty as h**l.

  5. Yes.  Democrats hate children and support rape.

    Did you read the article, or just the first paragraph?  I'm sure it's difficult for you to read that much.  He is expressing the concerns of a criminal defense attorney.  The attorney has a duty to protect his client, no matter what the client is charged with.  The harsher the penalty, the more brutal the attorney may have to be.  

    This whole "won't someone think of the children???" attitude presents the defendant's guilt as a foregone conclusion.  Anyone who believes that someone CHARGED with a crime should be punished needs to get out of America.

    He spoke too candidly, and presented himself as boorish.  However, his point is a legitimate response to harsher mandatory sentences for any crime.

    His comments do not reflect the sentiment of the Democratic party.

    EDIT:  Yes, actually, for the same reason the Supreme Court opposes the death penalty for rape (children or otherwise) so do I.  What I would do if it were my children is irrelevant - the victim's craving for vengeance should never dictate justice.  Also, I am not siding with the attorney and his rapist client, I am addressing the truth that you don't seem to see:  The attorney has an ACCUSED client, not a rapist client.  The "victim" may be lying, confused, or wrong.  The attorney has a responsibility to show that.  The accused is not guilty of anything until convicted.  Such is our justice system, and anyone who supports the death penalty for anything without understanding that has innocent blood on their hands.

    And, again, to address your original question:  Child rape and the punishment therefore is not a political issue, and you should be ashamed for trying to make it one.

He's a scumbag who should just burn in h**l.  Democrats are extremely hypocritical in their beliefs.  Democrats have been holding minorities down since civil rights and simply use them for votes but never do anything to improve their status.   The biggest scam in our country is the false belief that democrats look out for the little guy (poor, minorities, etc.)

  10. Yes it is sad. Many States had capitol punishment already in place for these creeps and now 4 left wing judges and 1 dumb *** right winged judge overturned this.  Sad.

    But on the bright side maybe we could fight for a law requiring they serve their sentence in the general population our prisons. I guarantee that will be like a death sentence.

Doesn't it make you feel all warm and fuzzy when a skirt chasing boozing democratic politician speaks of the terrible tongue lashing the rapist is going to get?  Not to worry though; I have a friend who is a guard captain at the state prison who told me that child rapists have to be segregated under guard at all times to keep the general population from killing them (but sometimes they slip up and take a coffee break; the guards).

  17. If he actually said this, he needs to be out of office as soon as possible. A child rape victim has already had his/her life "ripped apart". Anyone that would add to that is beneath contempt.

"...mandatory minimum sentences of 10 to 15 years for crimes against children."  First problem is mandatory minimum.  This has been tried with drug offenses and was an abysmal failure.  Second point is, this casts a pretty broad net.  The article didn't say WHAT crimes against children and some are worthy of lengthy prison time--but certainly not all.  Third is the fact that some teens have been sentenced to prison and required to register as s*x offenders when the offense was only a year or two beyond what the law stipulates; otherwise they were doing the same thing that others in their age group were also doing, which behavior I don't have to agree with in order to find that sort of punishment draconian.

    That said, I don't think that anyone with such poor judgement should hold an elected position.  This must be an example of cronyism at work.

  19. Not all Democrats are that evil, but the liberal ones are. Remember they vote to allow the murder of unborn babies, so ruining lives is mild compared to that. James Fagan will vote for Obama. I will vote for McCain.
