Is this illegal in anyway?

So here's the story...

say a s*x offender has his record expunged and is removed from the s*x offender registry. if someone were to post flyers or hand out the flyers at his college to warn his peers, would this be illegal? If yes, what makes it illegal?

  1. It is not illegal.  It is not libel, as it is a statement of fact.  Whether or not he is currently a registered s*x offender he committed a sexual offense, was convicted of it,  and has been a registered s*x offender.

    May suck for him and his family, but luckily the rights of the victim (and future victims) is more important than the rights of the convicted.

  3. i am not sure if that illegal, but i have always thought that once you are reg as a s*x offender its for life..You must register for the rest of your life if you are:

    Designated a sexual predator, a sexually violent offender or a predicate s*x offender, OR

    Classified as a risk level 2 or risk level 3.

    You must register for 20 years if you are:

    A level 1 s*x offender and you are not designated a sexual predator, a sexually violent offender or a predicate s*x offender.

  4. I do not see where it would be illegal because this falls under the 1st amendment and if he is a s*x offender people have the right to know.

  5. Im not taking up for him but yes-that would be illegal under those conditions. Think about it-you ssaid he is not on the s*x offender registry anymore-why was he removed from it? Regardless he is not on it anymore and you are printing up flyers that says he is and handing them out. In the least you are setting yourself up for a civil suit.

    Also those warnings that are sent out to warn people of a s*x offender in the area-those are suppose to be printed up and distributed by law enforcement, not  concerned citizens. There have been several cases where people have made those up about others they did not like and distributed them, even though the person had no sort of record at all. They just did it to hurt the person and get at them.

  6. I am so sorry (even though I don't know you) to hear that something of this nature has happened to you.  It's awful and the whole justice system is c**p.....have had a situation occur with a relative of mine....so I understand a little.

    Anyway -

    I do believe it is illegal due to the fact that this "monster" could claim defamation of character or something relatively similar, which is unfortunate, however...............................

    If a lot of people know about this, then it could have been anyone posting those flyers right?  What do they say.......It's not what you know, it's what you can prove!

    This sorry excuse for a human being deserves EVERYTHING that he gets, and your absolutely right, people DO need to be made aware of him

    Ok, maybe not illegal, but as the other gentleman had said....you can probably get sued.  Just refer to my earlier statements though....that's what I would do if this personally had happened to me

  8. Libel and slander is what your aiming at.  Slander is basically ruining one's reputation through talking, etc.

    Libel is more what your going for; ruining one's reputation by paper, flyers, etc.  

    The best thing is if it is true, meaning what is being said, it is not a criminal act.  If it is false, and one has reputation damaged then it is.  

    So, in your case if you put up signs with a picture and rapist printed on them, and he has been freed of all charges and removed from the list, then you are wrong.

    However, if he is still a s*x offender and was convicted then I would not recommend any harsh postings because it will likely draw negative attention anyway, but you will be in the clear.

    Give me those points!
