Is this illegal or legit?

I'm trying to buy a phone off ebay, and I see one of the sellers constantly sells new att phones, however in all the auctions it says

"PLEASE BE ADVICED THAT BAR CODE (UPC) WAS REMOVED FROM OUTSIDE OF BOX"

is this legit? is it illegal? why would the bar code be removed?

The seller probably got it with a mail-in rebate and had to cut off the bar code to send in with the rebate form.  Now the seller is trying to make a profit off of you.

I'd never do business with that seller.  Don't you at least suspect that these are stolen phones?

it is not legal here in the USA maybe in other country's it would be.

My best guess would be that whoever is selling the phone cut out the barcode/UPC for a rebate and that is why it is missing. Every rebate I've had with a cellphone purchase required me to cut the UPC and send it in with my rebate form. Although I'm not sure why they would have so many NEW att phones that all have the UPC missing. Maybe they're a re-seller for returned phones?
