  1. Yes it is. The last answer is correct, If the damage does not exceed a certain monitary amount (jay says $3,000 i thought it was $2,500 but you get the idea) the car can be repaired and sold without customer knowledge. Little dings and scrapes happen on new cars, its not really a big deal, we repiar them to new condition. If the car is damaged beyond that monitary amount then the car gets sold to an auction and the title is branded.

  2. If a car is sold as seen then it wouldn't matter what was wrong with it.

  3. They only have to disclose it if the title has been branded. What that means is the dealership would have bought the car from an auto auction and the title to the car would be in a "salvage" state. They dealership (according to state) would have the car inpected by the highway patrol. Then it is branded as a "rebuilt salvage". Rebuilt salvage cars are legal to drive and insurable. Anytime an insurance company buys back a car it is automatically branded salvage. In Ohio we have to disclose any brandings of the title. We have customers sign a form noting that they are aware of what was wrong. Ask to see the title before you buy the car but on the same note, the car could have been damaged and not have a branded title if the Ins. Co. didn't buy back the car. If you think you are being lied to, go somewhere else to buy a car.

  4. Plain and simple. NO!  That is if it is being sold as new. If this happen to you you do have recourse.

  5. Absolutely legal, unless the car sustained more than $3000 or more of damage.  Anything under that amount does not have to be disclosed.  Little mishaps happen often like someone else stated.  You could have bought ten new cars in your life and there is a good chance that at least a few of them were repaired before you picked it up.

A lot of it happens during transportation, a chain swings loose and damages the roof, the cars are too close together and hit each others bumpers etc.  These things you'll never know about.

  6. I dont believe so.

Hail damage wouldnt affect anything on the car apart from cosmetics.

Its unusual that a car dealer would repair hail damage, typically they would just sell it off cheaper or wholesale the car.

The car must have either been very desirable or the hail damage was only minor for them to have bothered.

  7. Of course it is legal.  Hail damage can be a minor repair and most of the time doesn't even require a re-paint.

There is nothing illegal about repairing minor damage.  It happens every day.  Hail damage, damage during transportation, back lot accidents,  stuff happens and the dealer has every right to fix the car and sell it as new.
