Is this rape law fair?

I just read that if a woman is so drunk that she is not in her right state of mind. Then has s*x with a man. She can claim that she was raped. Now my question is if a man was with the woman and was just as drunk, and not in the right state of mind. Should he be convicted of rape?

  1. That law was put in place for men who take advantage of women who are drunk. When you are drunk you dont have a clear mind to consent to having s*x. But besides that, lets be honest - how many men take advantage of young pretty girls at the bar who are falling on their asses? And if you are as drunk that is on you!


  2. Yes.  Any man low enough to have s*x with a woman in that condition should go to prison.  If he were just as drunk he would not be able to rape a woman.  If you can't find a sober woman to agree to have s*x with you, do it yourself.

  4. Yes, if the woman cannot or is incapable of consent it is usually considered rape in the second degree, or "date rape."

    It is more difficult anatomically-speaking, for a woman to rape a man, although not impossible. Because it is so rare, it is not commonly prosecuted.

    The law should and is supposed to work both ways, however. It is not that it is unfair, it just rarely happens. There have been many instances of g*y date rape in the male population, but many g*y males don't want to come forward, just as there are many women who never come forward either.

  8. i dont personally think its right because even tho she wasn't in her own normal state of mind the guy probably wasn't either. but nobody will listen to the guy in this kinda case anyway. i had to do a research project on a agency that protects battered women and part of it was to call the agency to get information. i got called a liar and got hung up on many times.

    i do think if the guy is sober enough to know his actions he should get the hammer thrown on him

Is rape fair, when a woman says not that is what it means and weather drunk or sober it means the same thing.  William the reason the battered women's shelters don't like to listen to men when they call for information is that is the ploy that the battery males use to track down their victims...The shelter is there for the protection of the women.
