Is this still statuary rape?

Im in a bar for people 21 and over I pick a girl up at the bar who is ordering and paying for drinks. I take Her home for a one night stand I kick Her out out in the morning. Its turns out She had a fake I D and is only 16. Will I be charged with statuary rape if She gos to the cops I met Her in a bar.

You could probably be charged, however, if you have witness to attest to the fact that she used fake ID to get in the bar you may have enough of a defense

maybe you should actually have a conversation with a girl before you take her home.. sometimes you can't tell by looking, but i'm sure you could have figured out that she was underage if you talked to her with any real interest of what she was saying... even if they are lying there will be glaring red flags going up

If you can prove due diligence - that you made a good faith effort to assure yourself she was of age, than you can fight the charge.  If she looks old enough to consent, and the ID was good enough to convince the average person it was real, then prosecutors may plea bargain with you, or drop the case entirely.  Also, in some states, a 16 year old can consent to s*x with someone no more than 24.

well, yes, technically i think that it is...but i dont think it'll get pinned on you. if you kicked her out in the morning and all that...i mean, i dont know. you didnt pick her up knowing she was 16. she was in a bar drinking, and everyone thought she was 21. even if she did go to the cops, i dont think that you'd see jail time or anything like that. Besides, she probably wont because she would be pretty much admitting to drinking underage, with a fake I. D

Yes, you can still be charged even if you had reason to think she was legal. As previously mentioned, she probably won't press charges because she won't want to deal with the huge hassle and possibly get in trouble herself, but she could (and if she gets in trouble with her parents over having been out all night with you, she might.)

In the future, try getting to know people better before sleeping with them!

Yep, you could be charged even though she misrepresented herself, the laws the law, and by kicking her out in the morning like that she might well feel used and seek revenge, if you dont treat people well, then dont expect to be treated well yourself!  (you've got to just hope that shes not vindictive, or her family find out cause they may take it out of her hands - next time to the right thing)

Yes, you could, because of you should have excercised reasonable caution and failed to do so by having s*x with someone you just met.  

To be safe, always ask for her driver's license and even "jokingly" take a close up copy of it clearly showing the DOB so you can prove that she presented herself to be of age to you.

The term statutory rape means exactly that...if you have s*x with  someone under the statutory age, regardless of the reason, it is considered statutory rape.

Think of it this way...if you run a red light, it is a statutory crime, regardless of the reason why it happened.

You might need the services of a lawyer but if you can prove you were deceived and have witnesses to back you up you  shouldn't have anything to worry about. Hey she fooled the bartender too right?

I have an friend who some  years back actually took in a girl who claimed to be 19 but was only 15 and a runaway (she sure fooled me) and they lived together for a couple months. After he found out through a couple other people she was a minor he gave her the boot.

Dude was sweating it for a time but nothing happened. From what I heard she just linked up with someone else.

it might depend on the state.  in canada, the age of consent is 14 as in china.

in the us, some states allow a 4 year 'window' between ages.  it is possibe that a good lawyer can work magic in this case, but remember, in most jurisdictions, if you are convicted of a crime like this, you are labeled as a 's*x offender', possibly for life.  

people here that you are registered as a s*x offender and suddenly, you are a monster, child molester, rapist, scum of the earth.  hope you don't get convicted of that.

i would strongly suggest you proactivly contact a lawyer for a free consult... and keep him or her on standby.

and secondly, i would strongly suggest, you treat the girls you pick up a little bit better.  i think you would benefit from the services of a prostitute or someone looking for s*x without commitment.

run an ad on craigslist.com for a no commitment, physical only relationship.  don't offer money... find out what is considered entrapment in your jurisdiction and stay clear if it looks like it is a setup.  you might be able to find someone for a quickie as a regular thing... then you don't have to be an *** and kick out the one night stand in the morning.

I don't think she would go to the police since she obviously wanted this--unless you did something mean you did not tell us here--however if her boyfriend or parents found out that could mean trouble.. Since you met her in a bar under these circumstances you would probably do little to no actual jail-time----however--once an incident like this goes on your police record you get a life sentence as being a known s*x-offender. Once something like that happens it's like a bullet---you can never call it back or undo it.I'd be real sure in the future of their age----only takes once----and you would always carry that with you wherever you go. wind up in jail later for anything at all and Bubba will get you
