Is this worthy of a law suit?

The local hospital released my girlfriends mentally and physically unstable mother without notifying the family and without meds.

She is schizophrenic, has random seizures, and has an inactive thyroid and she needs meds for all three to survive.

She was admitted at about 1 AM last night after having an episode and this morning we called at 7 AM to check up on her and they said they released her tow hours ago and didn't give her as much as a prescription (which she wouldn't be able to fill anyways). This person cannot support them self.

I should also mention that she has been missing for the past 2 years and we tracked her down when there was finally an address listed with her last name in the area just 3 days ago (it was a group house of some sort).

Don't you think the hospital took way too big of a risk by releasing her into the public, considering that she was taken there by people that said "call us if anything happens, we are her immediate family"?

as of right now she is still missing, and the stupid police policy is that they can't notify us if she is picked up because she is over 21. even if we file a missing persons report.

I think a law suit is in order, how about you?

  1. she is an adult, she was treated for an acute episode and then released. the hospital is not reponsible for what she does or doens't do, and her doctor is the one who should provide her meds.

    what exactly would a lawsuit accomplish, even in your wildest dreams? make her come back?

    you already said your gf and her family can't keep track of her for years, why is it different now?

    maybe you and your gf should sue each other, makes as much sense as your proposal

  3. What's the hospital supposed to do, hold this woman against her will?  If she's unable to take care of herself she should have a guardian appointed.

  4. Unless the mother has been LEGALLY declared incompetent, the hospital CAN'T legally inform anyone without HER permission.  Your issue is NOT with hospital policy.  Your issue is with Federal law.

  5. It is her lawsuit to file.  She has to have been harmed by the actions of the hospital, and there is a lot about this case we do not know.  You need to find her and have a conservator appointed for her, with the girlfriend in charge.  Find her, and see how she is doing.  Maybe she just does not want her daughter to find her.
