Question:

Is what my boss did illegal?

ok so my company works on a point system. im still on my 3 month new employee probation (only had a week and a 1/2 left for the record) which is an allowance of only 1 point.. i had been sick once during that time which counted as 1 point. so i was served a final warning write up and was expected to be on time every day from then on.. unfortunately as of friday i got stuck in traffic. i called ahead to let her know i would be 15-20 mins late. at this time she never mentioned that being late would count as a violation. she allowed me to come in, clock in and start work. she had me clear all the shipment from the hall since we had the district and regional managers coming in the next day and wanted everything clean and tidy. I worked on shipment for a total of 3 hours, once finished, i went to go on the fl0or to assist customers. At this time she asked me into her office to let me know me being late was a violation and that i was suspended until they decide whether or not i would be terminated.

i dont deny the terms of my suspension, but is it illegal that she knew of my violation and allowed me to work for 3 hours into my shift only to benefit herself and then once the task was completed to take my keys and suspend me??? im no expert on labor laws but this seems wrong..

  3. It's not illegal but maybe a little unethical in my opinion. If they have not let you go yet that's interesting. If they don't follow policy for everyone you might have a case.

    Your lucky most cases your let go the same day. It's a good sign you're still there.

  4. not only is this legal but they have gone above what is required.

    progressive discipline is not a requirement of law it is done to try and save the employee by allowing them to improve instead of just firing them.

    you will be paid for the hours you worked, how is that to the sole benefit of someone else?

    you knew the policy, you violated the policy and now you wonder if what they did was right, how about your failures in this?

    do they not deserve employees who are at work as scheduled when scheduled?

    you probably will get a few days suspension and then be back on the schedule but it is all a matter of the companies policy.

    if you are terminated, learn from this and become a better employee for the next employer.

    i am in no way condoning termination in this case but i do believe in following policy.

    "say what you mean and mean what you say"

    goes along way at work and in life.

  5. Were you paid for the time you worked?  Why would it be illegal for her to time your suspension to the benefit of the company?  

  6. Not Illegal.  She may have had to speak to other managers or higher ups before knowing how to handle the consequences of the time violation.  As long as you get paid for your 3 hours, they are not in violation of anything.

    But seriously sounds like a crappy company to work for. I'm like 2-5 minutes late everyday, I'd be so fired by now if i worked there!  

  7. i dont think it is legally wrong. It might be that she was going to let your tardiness slide, but the regional managers may have found out about your points and ordered her to do something about it.  

  8. If it is not it should be. This sounds like something a fast food establishment would do.

  9. no, as long as they pay you for the 3 hours I don't see anything illegal happening here...

    you know, i don't even know you, but you deserve much better than this....time to start looking elsewhere in my opinion.  There are way too many power tripped micro managing jerks out there....let them ruin someone else's life, not yours! :)
