Is working 16 hours a day consider an overtime pay?

I have been working for this company for 3 years 40per week, but my schuele look like this

Mon from 11pm-7am, then go back home, and come back and do 3pm-11pm, 5 days like that. but the total is 40/hr a week, so is working 16 per day make it an overtime pay or not/

  1. I would not think so.  Only if you went over your 40 hours, but it could vary depening on where you live.


  2. In the states that I know of, a 40 hour week is normal, regardless of the number of days it is spread over. Over 40hrs in a week would be considered overtime (unless on salary). Overtime is not figured by the number of hours worked in the day, but total hours worked in the week.

  4. No it not consider OT.  You are still at 40hrs.  Even if you clocked out for that morning and clocked back in that afternoon you are still with in the 40 hr cycle not to mention that 8 hr break.

  5. Unfortunately, as long as you're not working over 40 hours a week, it's not considered overtime and your boss is not required to give you overtime pay.
