Isn't this overreacting to a fake id?

my friend tried to use a fake id at a gas station, but they took it and as he walked out of the store, someone behind the register ran up on him, put him in an arm hold and tried to get others to call the police. Eventually the other guy behind the register said to just let him go, but isnt that still overreacting? Has anyone else been caught with a fake id and what happened. I figured they would just be told to get the **** out the store and that would be the end of it, but who knows

  1. It is a federal offense but it is a bit over the top if you ask me. I had one and got turned down a couple of times but I never had it taken. My roommate got caught by the police with his but he didn't get into to much trouble really, just had to go to court. So yea, I think that a random person trying to put me in an arm hold is not only over the top, but borderline assault.


  2. i would say that is over reacting and your friend should have stayed for the police to come so he could press charges on the guy who assaulted him if he was using the id the person who knew it was a fake should have cut it up and that would be the end of it the other guy who got physical was way out of line

  6. When my sister used one they just took it but only because it was expired (we look ALOT alike) and that was the end of it...Maybe cause she's a girl? IMO that's a good way to get stabbed runnin up on someone for something like that? They're lucky your friend isn't crazy.

Simply being told to get out of the store is punishment for trying to steal a piece of candy.  Its not a reasonable punishment for fraud.  When you attempt to use a fake ID you commit two crimes.  1)  Attempting to purchase alcohol as a minor.  2) Committing a fraud.  If I was the employee at the store or the owner I would definitely hold you until the police arrived.  The fines against the store for selling to someone underage (with a fake ID or not) are horrendous.  No store wants to take the fall for that.  Why not avoid the risk by making it clear to the police that you don't tolerate it and making sure those accountable are punished.

    This was not a case of overreacting.  It was a case of underreacting by the other employee that let your friend go.  If you caught someone trying to steal your wallet, would you simply tell them to get lost or would you turn them into the police?  It may be a different crime but it is still that, a crime.

  8. No. It is a big deal to get caught with a fake id. I had a buddy get pulled over for speeding and when he opened his wallet to pull out his drivers License the cop saw his other ids behind his real one and pulled him out; searched him; and took him to jail.

  9. By using a fake ID your friend (?) was breaking the law. He was, probably, using the fake ID in order to buy beer or cigarettes, which is breaking another law.

    He should be prosecuted since he obviously has no respect for the laws which everyone else obeys.

    Had thre clerk sold him beer the clerk would have lost his license and, perhaps, paid a hefty fine.

    What you friend (?) sees as cute is actually vicious.

    It is perfectly legal to restrain someone who commits a misdemeanor.

  10. It is a crime to use a fake ID to attempt make a purchase of restricted sale items.  If you do you can be arrested and charged.

  11. yes thats absolutely rediculous who cares anyways it was at a gas station ...depends if he was tryna buy butts or a dutch or somthing like beer. booze is more serious with a fake id obv. but not necessary to call police from a gas station......

  12. yes that's over reacting, they have no right to attack you for that. sue him for assault. A citizens arrest does not give you the right to attack people and they are not protecting anyone by hitting some teenager who's walking away. You can call the cops get a description, even follow them with a cell phone but you can't fight unless to protect your self or others from a clear danger.

  13. well if it was fake id for alcohol then maybe it was a little nessisary but not that much, but if it was for tobacco then thats dumb by brothers friends go in to gas stations all the time and they dont get caught, and also if ur friend tries this again tell him just to say i forgot my i.d my bro does that all the time

  14. it is illegal to restrain someone for a misdemeanor crime.  The person who held him down could have been charged with false imprisonment.  If the kid had held up the store, that is a felony and there are state laws that say a reasonable amount of force can be used to prevent the person from leaving and doing harm else where.  The fake ID is a misdemeanor and not a felony.

  15. No because if the store clerk would have been caught they could be fined 10k...the kid was essentially trying to give him a 10k fine

  16. They should not have used physical force to restrain him unless he was attempting to escape.

    Using fake i.d. is a big deal and it does warrant the police being called but from the sounds of it the guy went a little commando on your friend, using extreme tactics that were not necessary.

    Unless your friends was attempting to leave the premises knowing that the police were being called (escaping) then there was no need for the action to be so extreme.
