Item brought from internet not new as stated?

i brought a toy from an ebayer and as it said new i wanted to check for definate , i emailed the seller and asked this......

hi there can you tell me are these machines brand new and not returns or seconds please.as i want it perfect due to it being a present.

to which the seller replied ....HI...they are brand new, but the boxes are worn and damaged......please do not buy if your not happy with those conditions......

fair enough i thought i can handle a box a little worn etc..

i received the item today and its clearly a argos returned item i thought by law that a seller had to mention this. does anyone know what i should do ,i don`t really want to send it back as i know the weight of the item would cost me a lot and i would be out of posket.. where does the law stand on this please..thanks

  4. I will be as honest as I can...

    ebay sucks when this happens & if you dispute & mark them as a non performance seller, you have to return the item at your cost to the seller in the condition it was sold in (ebay rules)

    the seller can turn round & say you returned it in worse condition than it was sold. ebay goes in sellers favour. you have paid for item paid for postage twice & now have no item no refund but neg feedback.

    I before now have actualy taken items back to the shops (argos) that i have brought off ebay & been given full refunds without a reciept (as long as its still in the catalogue).

    ok maybe dishonest but i got my mony back or a new replacement.

  5. I'm afraid this is the downside of shopping on eBay. There is very little you can do. The whole thing relies on trust. Yes you could send it back but you might never see the money again. You can complain to eBay but they don't do much. It happens to the best of us. But nevertheless..do try!

  6. Ask The Seller If It Would Be Possible To Return For A Full Refund ( the Seller Should Pay The Postage).  If Not, File A Dispute On Ebay.  If This Is Not Resolved Then Ebay Will Step In And Decide The Appropriate Action.
