  1. The bank will want to cancel the card as soon as possible to prevent further fraud being carried out. Under the Banking Code, if you have been an innocent victim of fraud then your losses will be met. However, if the bank can prove you have been negligent with your card and Pin, it may hold you responsible. The bank will investigate the crime and give you an estimate of how long it believes the investigation will take. It should also give you a 'shadow' overdraft so you can carry on using your account.

    The difficulty for consumers today is to prove that they haven't been negligent with their card. If the fraud has been carried out on your credit card and the issuer finds you negligent, then, according to the Financial Ombudsman, the amount you are actually liable for is only £50.
