now lets say i own a business in the u.k and i know someone who would be great for a job but lives in america whats the deal with the visas how can i get him over here to work for me

  1. if its a job that you could employ someone from the UK to do you have no chance getting him a work permit. If its a specialist job you should be able to.

In order to bring a non-EU or non-British national to the UK on a work permit you first need to offer them a position that meets the minimum skill requirement and the individual needs to have relevant qualifications and/or experience for the role.  There are many steps that the Home Office require to be carried out, the most important of which is the advertising for the role.  You must show that you cannot find anyone to fill the vacancy in the UK before applying for the person you are interested in employing.  The timescale is roughly 2 and a half months.

    An administrative position will not qualify whereas a managerial one will.  The documentation required for the application revolves around proving you are a UK based employer with a trading presence and proving the candidate is suitable for the job (references, qualifications etc).

    Once the work permit is approved in the UK the candidate then applies for Entry Clearance at the British Diplomatic Post in their home country to activate the work permit.  You can ask for any duration up to 5 years.
