Joint Shared Custody?

On the joint custody paperwork, can my husband file to have Monday & Tuesday nights, every other weekend starting on Fridays, summer, and alternate tax year with his daughter. Or will the judge have a problem with this request.

  1. I have a SRO and we sorted our complex contact arrangement between ourselves. As long as the 2 parties agree there should be no problems.

Most states have standard custody/visitation guidelines that the courts will go by unless the parties agree to a different arrangement.  If you are willing to agree to joint physical custody, you can propose a different schedule, the judge may send you both to a mediator to try to resolve your differences, he may accept one or the other plan, or he may substitute his own plan.  The more you appear to be willing to work with your ex, the better you will come off in court.  So, consider all options and submit your plan.  Most couples divide the summer, not one person gets the whole time.  . alternate tax years is reasonable.  But you might want to consider a back up plan in case one of you moves, or be sure that you can both maintain the same schedule when the child is in school  Best of luck!

Shared joint custody usually means 1/2 and 1/2.  My nephew has his boys every other week from Friday to Friday.  This has really worked out better than expected.  The children have adjusted and know the schedule.  Fathers want and can expect to be allowed as much time with their children as the mom.  If it is fair then don't keep dad from the kids.  They need him too.

  4. Sounds as complicated as my wifes. Whatever you both agree to the court will just sign the order. They won't recommend anything if you agree to what you have written up on your own.
