Joint Venture Real Estate?

I know that you can sell properties owned by others with an option to buy. But can you use a joint venture agreement with the owner to do the same?

  1. You do not create an entity simply be calling the intent to do real estate business with another, a "joint venture".

    Therefore, since your "joint venture" does not exist in any legal capacity, you cannot contract with it.

    You need to create a business association out of your "joint venture" in order to contract. Therefore, it can be a corporation, some form of partnership or even an LLC (very popular amongst sophisticated players).

    Otherwise, you will simply create a real estate deal (contract) with your individual names or have a contract that doesn't exist in law (void) if you decide to draw it up with only the term "joint venture".
