okay i have been reading about this whole process when non us citizens marry americans now the questions i want to know is how why do people say they have to be married for atleast 2 years before they are granted a green card also when can they petition to bring other family members over to the states from their country and how long does the family member have to wait what if they got married to a us citizen and have a wife back home once they get their green card does the spouse have automatic citizenship to be here i mean i am just wondering what is the whole process and the wait process good answers and the best gets 10 points thanks alot

  1. This is just relating to your additional details, since the rest of it is irrelevant.

    Firstly, what your friend and the non-U.S. citizen have done is illegal. It is called marriage and visa fraud, which is punishable by a maximum penalty of 10 years in prison.

    Secondly, if either one of them were married, as it appears the non-citizen was/is. Then their marriage is void, a person cannot be married to two people at the same time. A divorce must take place and the divorce papers must be hand before one can be re-married. Any marriage which takes places, when one person cannot legally do so, will become null and void.

    So when the time comes to bring his real spouse other, the marriage certificate will show that he was still married at the time of his marriage to the U.S. citizen and then I am sure you can figure out the rest on your own.


  2. if the person marries before all the paper work is filed and fees are paid and is in the country illegally at the time of marriage then it wont matter if they were married or not the illegal will be sent back their country and not be eligible for 10 years to return to the US legally. a man down from me the street had been living in the US for more than 16 years and they tried to deport him. he was married, had 3 children and own a buisness. i dont remember if they sent him back or not he was from italy

    the person has to be married for at least 2 yrs before they get a green card and pay all the fees that are included because the gov't has to determine if the marriage is  a fraud or not. then after the waiting period the person has to take a test that even most Americans wouldn't pass due to the lack of education given now. as soon as the person becomes a citizen they can sponsor family members to come to the country and eventually get geen cards and citizenships.

The U.S. citizen can apply for green card for spouse immediately after marriage, INS will issue a "conditional" green card good for 2 yrs. 90 days b/4 the 2 yrs. you must file to remove the conditions, if approved spouse will be granted permanent residency, after 3 yrs. of continued residence in the US spouse can apply for citizenship, once this is approved they can request most family members. As far as how long it takes it depends on the relation ie= son, daughter, parent, brother etc. INS has different categories and priority dates.

  4. No none of this is true any more. Marriage has been removed from the tactics available for illegals to work the system.

    The two year relationship refers to the K1 visa.

    If someone has illegally entered the US the only way they can gain documents is to return to their home country and apply from there.
