How far back can I refile to correct the error. I believe the government owes me a lot.

  1. What is the error?

Some errors can be fixed with a "change in accounting method" and others are lost after 2 years.

  2. Hmm, I really don't know.  I would ask your accountant about that and possibly a lawyer to inquire about a refund and everything else that deals with the government.

  3. Most of the answers so far are correct. However, without knowing what the " boo boo" was it is hard to say if it is correctable now.

In some cases the error might be corrected either on a current return or one in the future (these are rare though). But, once you file any amended returns that option disappears.

I would suggest talking to a qualified Enrolled Agent or a CPA that specializes in taxation.

    Hope this helps.

  4. Tax years 2005 - 2007 are still open for refunds.  Anything from 2004 and earlier is lost forever now.

  5. You can amend your returns as far back as you want.  You may receive a refund for amendments filed within three years of the filing deadline for the return, or within two years of payment of taxes, whichever is later.

So returns filed and taxes paid for 2005, 2006, and 2007 would be eligible for refunds.

  6. You can file 2005 and later tax returns.

To get refund on 2004 tax return, the due date was April 15, 2008.
