random but, i was thinking.. what if it was the day before the mans birthday, he was 17 turning 18...

he and his 17 year old girlfriend were having s*x at 11:59. if they do it until 12:01 and the girl is 17 and the man is legally 18.. would that be rape?

No, rape is being forced into s*x...

Statutory rape is when one is under 16 and the other is 18 or older.  If a 16 year old has s*x with someone no more than 3 years older (no older than 19) it isn't considered statutory rape in most states.

I highly doubt it since there is only 1 years age difference.

Now, if you're talking about a 13 year old and a 17 year old turning 18 then yeah, it would probably be statutory rape and pretty icky.

if u have been having s*x and shes into it as well . then highly doubt.  u could TRY for a case but highly doubt it would hold up in court

no, if there 18 or over, you can still have s*x with them as long as your no more than a year younger.

If you want to get really technical, I suppose it could still be considered statutory rape. But I highly doubt a case like that would stand up in court.

well,rape is unwanted s*x ....not always underage ,unless reported and taken further legally. If it is taken further then yes its rape, the birthday persons 17th has ended and 18th has started.

Ohh..and if its not taken as rape of an underage child,then it can still be taken as BOTH underage sexual activity..hope it helps;))

Age wouldn't define whether it was rape or not.

If a 17 year old girl and a 18 year old boy had s*x, it wouldn't necessarily be called rape (perhaps they are dating and they both agree to it, making it consensual s*x, which means both parties are agreeing to it).

Rape is unwanted.  If the 18 year old wanted s*x and the 17 year old didn't and he forced himself on her, that is rape.

To answer your question, I think you're asking about the timeframe.  Technically I think the 17/18 year old boy would be TECHNICALLY have s*x with a minor even if he started at 11:59 and went until 12:01 the next day, making him 18 years old (and one minute).

Ha. I've wondered the exact same thing and actually asked an official about it.

They said as long as the age difference isn't over 2 years and they were dating before either one turned 18, then it's completely legal. :3
